You are using Encountr LLC’s (“Encountr ”, “We”, “Us”, “Our”) mobile application (the “Encountr Application ”), and any other mobile or web services or applications that Encountr has or will have (all of them are the ("Encountr Services”). Encountr Services” The people who access, download, use, purchase and/or subscribe to the Encountr Services (together or separately “You” or “Your” or “User” or “Users”) must agree to the Terms and Conditions of Service (this “Agreement”) that follow. Read carefully before creating an account on Encountr:

Don't get stuck paying for Encountr Plus/Unlimited longer than you want! These subscriptions renew automatically, but you can easily cancel before your next payment.

We can't guarantee every nook and cranny on this planet welcomes Encountr with open arms, so it's your responsibility to check if it's kosher where you are. Be genuine: When crafting your Avatar, ensure the information you share is accurate and stays up-to-date. Remember, you're representing the real you! (Age verification is important, so please be truthful about your birthdate.) Remember you must 18 years old to enter or register with Encountr, no exceptions.

Solo adventures only: Your Avatar is your own unique space. Sharing your account or credentials is a NO-GO, and selling or renting access is strictly prohibited. Treat it like your personal passport to the Encountr world.

Lock it down: Your password is your shield. Keep it strong and keep it secret. If anything fishy happens, like unauthorized access, let us know immediately. We're here to help!

At Encountr, your privacy matters. We've got a dedicated Privacy Policy that's all about how we handle your data and keep it safe. Want to know what happens to your info? Just head over to the Privacy Policy section. By using Encountr, you're giving us the green light to use your data in the ways spelled out in the policy.

Listen up, Encountr users! We take your privacy seriously, that's why we have this whole Privacy Policy thing going on. It's basically the lowdown on how we handle your data. We at Encountr are all about keeping your private stuff private. We call it "privacy," not "privacy policy," but that's just technical mumbo jumbo. Anyway, if you're wondering what we do with your info, read the Privacy Policy (it's not as scary as it sounds, promise!). By using Encountr, you're saying "okay" to us handling your data according to the Policy. So, relax, we've got your back (and your data).

Service Adjustments & Revisions

Encountr reserves the right, at its sole discretion, to modify, add, or discontinue any or all of the Encountr Services at any time and for any reason, without liability to you except as otherwise. However, Encountr reserves the right to make such changes without prior notice if it is necessary to comply with applicable laws, protect or enforce

legal rights, or address or prevent an emergency.

If Encountr makes material changes to the Premium Services that: (a) reduce the functionality available to you on such Premium Service and (b) are mandatory (meaning you cannot access the Encountr Services without accepting the changes), you may terminate your account within ten (10) days of such modifications and receive a pro-rata refund for any amounts you have pre-paid for but not used for such Premium Services.

Encountr reserves the right at any time to introduce fees for access to all or portions of the Encountr Services and to adjust such pricing at any time, provided that any such changes will not affect the fees for any Premium Services that you have already purchased.

If we make any major changes to your fancy Premium stuff that take away features or force you to update, you've got ten whole days to decide if Encountr's still your vibe. Just peace out within that window and we'll hook you up with a refund for any unused Premium time.

Speaking of moolah, we might need to adjust the price tag for some or all of Encountr down the line. Don't worry, though, any Premium plans you've snagged already are locked in at the current price. Cool beans, right?

The Encountr Services are subject to change at our discretion. We may modify, add, or discontinue features or functionality at any time and for any reason. We will endeavor to provide notice of any material changes, but reserve the right to implement changes immediately if necessary for legal compliance, to protect our rights, or to address emergencies.

If we make significant changes to the Premium Services that reduce available functionality and are mandatory, you have the option to terminate your account within ten (10) days of the change and receive a prorated refund for any unused Premium Service time.

We may introduce or adjust fees for access to all or parts of the Encountr Services at any time. However, any such changes will not affect the price of any Premium Services you have already purchased.

Encountr's Ownership and Intellectual Property Rights:

All content, design, and technology found within Encountr (its website, apps, and any other services) are owned and protected by Encountr itself, its affiliates, or its licensors. This protection extends to copyright, trademarks, trade dress, patents, and any other applicable intellectual property laws. Using any of these materials without express permission from Encountr is strictly prohibited.

Encountr is Ours, and So is its Stuff: Everything you see and experience on Encountr, from the snazzy design to the powerful matching algorithms, belongs to us (aka Encountr) or our buddies (that's right, we have buddies). Copyright, trademarks, patents, the whole legal shebang – it all applies. So, playing copycat with our stuff is a big no-no. Just like borrowing your bestie's favorite shirt without asking.

Encountr's Intellectual Property: Don't Steal Our Shiny Bits: We poured our hearts and souls (and probably some late-night pizza) into crafting Encountr. So, the cool tech, the witty slogans, the irresistible design – they're all ours, like a prized collection of action figures. Don't be the weirdo who swipes them from our metaphorical toy box. Respect the copyright, trademarks, patents, and all that jazz. Otherwise, well, let's just say karma has a way of bringing back bad flirting experiences.

Hands Off Encountr's Intellectual Property: It's simple. Encountr owns everything you see and interact with on its platform. Copying, modifying, or distributing any of it without our permission is a big NO-NO. Think of it as borrowing without asking – rude, illegal, and likely to land you in hot water. Keep it Personal, Not Commercial: Encountr is for making connections, not making money. No selling things, promoting businesses, or spamming surveys. Keep it real and keep it personal.

Laws are Laws: Don't use Encountr for anything illegal or that breaks local, state, or national laws. Play it safe, keep it legal, and avoid unnecessary drama.
No Kiddos at Play: Keep your profile PG-no underage photos, videos, or stories. Let's keep things appropriate for adults only.
Spam Alert: Don't be a digital pest. No unsolicited messages, ads, or chain mails. Keep your inbox clean and your Encountr interactions genuine.

built Encountr, and we get to set the rules.
Don't Be a Buzzkill: Don't ruin the fun for others. Avoid disrupting Encountr or interfering with anyone's use of the platform.
Be a Good Sport: Play fair, be respectful, and keep the Encountr community a positive place to connect.

Services and Purchases: Subscriptions

Certain features, called "Encountr Plus" or "Encountr Unlimited," might require creating an account and paying a fee (collectively, "Premium Encountrs"). These accounts grant access for a fixed, automatically renewing term. Costs and details are displayed when purchasing.

Premium Encountrs automatically renew continuously at the end of your term, charging your chosen method with the current renewal price (plus applicable taxes). You agree to this automatic renewal unless you cancel or we take action as allowed in this agreement.

You can cancel Premium Encountrs anytime following the provided instructions within the Encountr app. There are no cancellation fees.

Trial Encountrs:

Limited-time free trials ("Trials") of Premium Encountrs might be offered occasionally. This agreement also applies to Trials.

You may need to provide credit/debit card information when registering for a Trial. Your card will only be charged if you don't cancel before the Trial ends. If you provide card information and don't cancel before the Trial ends, it might automatically convert to a paid subscription, charging your card the subscription fee at the time the Trial started. Trials aren't available to previous Premium Encountr users or those who previously received and cancelled a free trial.

We reserve the right to fix errors (by changing information or informing you and offering

cancellation) or update information at any time without notice. We may grant or deny individual order cancellations at our sole discretion. All sales are final.

Promotional Codes:

Encountr may, at its discretion, offer promotional codes for discounts. These codes are non-transferable and not redeemable for cash, credit, or past purchases. No cash alternative. Codes can't be combined with other offers and must be redeemed by the published date, if provided. Lost codes cannot be replaced. Limit one code per customer. Codes are void where prohibited. Any promotional program may be terminated or modified by Encountr at any time at our sole discretion.

Payments:

all payments to Encountr are final and non-refundable. Cancellations take effect the next billing period after payment is due, unless otherwise stated in this agreement.

Taxes:

Unless specified otherwise at purchase, all payments to Encountr exclude taxes. You are responsible for paying all applicable taxes.

Microtransactions:

You may sometimes purchase limited, non-transferable, revocable licenses for specific add-on features within Encountr ("Microtransactions"). Encountr reserves the right to charge fees for accessing/using add-on features or distribute them with or without charge. Encountr may manage, modify, or eliminate Microtransactions/add-on features at any time. Any add-on feature balance shown is not real-world money but reflects the extent of your license. Unused add-on features have no fees, but the license granted through Microtransactions terminates when we stop providing Encountr or your account is closed/terminated. Encountr has no liability for exercising any such rights. Add-on features are a service that begins immediately upon accepting Microtransactions. ALL MICROTRANSACTIONS MADE THROUGH ENCOUNTr ARE FINAL AND NON REFUNDABLE. YOU ACKNOWLEDGE THAT ENCOUNTr IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED ADD-ON FEATURES WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.

Want extra perks like unlimited swipes or seeing who likes you first? Score yourself some "Encountr Plus" or "Encountr Unlimited" with a paid account. Just set up an account and choose your plan - it'll keep going until you tell it to stop. Prices and details are always right there for you to check.

Bonus tip: Don't forget, these subscriptions renew automatically unless you tap "cancel" before the next round starts.

Free Trials FTW:

Ever wanna test drive the premium life before committing? We offer limited-time free trials of Encountr Plus/Unlimited from time to time. Just remember, if you give us your card info for the trial, we'll assume you're loving it and charge you automatically unless you cancel before the trial's up. No hard feelings if you change your mind, though - cancelling is easy-peasy.

How You Use Our Services:

Your access to certain features of Encountr may require downloading the Encountr mobile application. Viewing your account details, including chats, hinges on having a registered Encountr account.

Encountr reserves the right, but without any obligation, to monitor user activity within the Encountr Services, including account creation, messaging, and interactions with other user profiles and location information. Consequently, Encountr also reserves the right to: (a) temporarily restrict user access to Encountr features, including other user profiles and location information, or (b) permanently terminate user accounts for any reason, with or without prior notice and without any liability to the user. Refunds will only be issued as explicitly outlined in this Agreement.

You understand you are solely responsible for your interactions with other users and any content you contribute to the Encountr Services. Encountr will not be held liable for any losses or damages resulting from such interactions. Encountr reserves the right, but has no obligation, to mediate disputes between users.

Encountr does not control the content of user accounts and profiles. Encountr has the

right, but no obligation, to monitor such content for any purpose. You acknowledge that you are solely responsible for all content and material you provide to the Encountr Services.

To unlock the full potential of Encountr, downloading the mobile app is a must! You won't be able to check your messages or account details without an Encountr account.

Heads up, Encountr can peek at your activity sometimes (but don't worry, it's not stalking!). This includes things like signing up, chatting, and browsing other users' profiles and location info. That said, Encountr also has the power to: (a) put a pause on your account access if things get weird, and (b) say "hasta la vista" to your account for good, whatever the reason. Just a heads-up, refunds aren't always a guarantee, so check the Agreement for the deets.

Remember, it's you, not Encountr, responsible for your encounters! Be mindful of what you share with others on the platform. While Encountr can take a peek at what's going on, it's not their job to babysit every conversation. If things get messy, remember Encountr can step in to help sort things out (but again, not always!).

Finally, keep in mind that your profile and what you post on Encountr is all yours! Encountr won't control it, but they might take a look from time to time. Just remember, whatever you share out there is your responsibility.

Listen up, Encountr likes to keep an eye on things - not in a creepy way, just making sure everyone's playing nice. This means checking out stuff like how you say hello, the messages you send, and even where you're hanging out (virtually, of course!). But don't worry, your Encountr freedom isn't on the line unless things get wild by doing thing that are against the law. Encountr can put your account on ice for a bit, or even show it the door permanently, if the vibes get seriously bad. And don't expect a refund unless the Agreement says so, wink wink.

Remember, your Encountr adventures are all yours! You're the captain of your ship, so choose your crew wisely and be mindful of what you share. Encountr might glance over your shoulder now and then, but they won't be writing your story. So grab your virtual compass and explore the Encountrverse responsibly!

Termination Clause: suspension of your services

Sayonara, Encountr Buddy! You can ditch us any time, just follow the clues in the app. No hard feelings, your Encountr adventure just ends. But if you're hooked on our Premium plan, you'll still get to play till the whistle blows on your current billing period.

Dissolving your Encountr bond. You may terminate your Encountr account at any time, for any reason, following the provided steps. This severs our ties.

Farewell, fellow Encountr-er! We're sad to see you go, but you're free to fly the coop whenever the mood strikes. Just remember, if you're on a Premium quest, you still get to enjoy the full ride until the clock chimes on your current subscription.

Encountr: Termination Tango. ⛔️ If your Encountr profile or actions break our rules (the Terms of Service, remember those?), or you tango with another clause in this agreement, we might have to cut the cord on your account. It's our sole discretion.

Encountr swipe left on you? Bummer! You can cancel your account any time, no drama. Just head to the settings and follow the prompts. If you're a Premium player, you might get to finish your current level before we say goodbye or you might not.

Authentic Individual Organic:

Content: What's Yours and What's Ours

On Encountr, you get to express yourself with photos, ideas, and even creative sparks you've been itching to share. We call it User Content (because, well, it's yours!), and it adds the spice to our community. But before you unleash your inner Picasso, let's talk about a few ground rules:

• You, the Boss of Your Content:

You own your creations, period. From that witty bio to the sizzling selfie, it's yours to flaunt, tweak, or even hide away whenever you please.
You're responsible for what you post, the ripples it makes, and how it interacts with other Encountrians. Remember, kindness is key!

• Permissions and Paperwork:
Make sure you have the right to use what's in your content, especially if it involves other
people. Don't be the one causing awkward explanations about blurry faces or surprise appearances.
If you're featuring someone recognizable, get their okay in writing. Trust us, it avoids messy situations later.
• A Universe of Encountian Content:
You'll encounter all sorts of stuff on Encountr, from hilarious one-liners to artistic masterpieces. We can't control everything everyone posts, so be prepared for diverse (and sometimes surprising) voices.
• Our Role: Facilitators, Not Editors:
